New Publication: On the Confiscation of Proceeds of Cum-Ex Transactions from Third Parties Involving the Division of Proceeds

An article by attorney Professor Dr. Petra Wittig has been published in the journal Wirtschaftsstrafrecht und Haftung im Unternehmen (ZWH), which examines the ruling of the Federal Court of Justice (BGH) dated July 8, 2025 (1 StR 58/24), which addresses the issue of third-party forfeiture of criminal proceeds in Cum-Ex transactions in cases involving the division of proceeds (ZWH 2026, 95–99).
